263.509. 1. The director of the department may enter cotton fields,cotton processing facilities, and other premises in order to carry outsuppression or eradication activities, including, but not limited to,treatment with pesticides, monitoring, and destruction of growing cotton orother host plants, as may be necessary to carry out the provisions ofsections 263.500 to 263.537.

2. The department may make inspection of any fields or premises inthis state and any property located therein or thereon for the purpose ofdetermining whether such property is infested with the boll weevil. Suchinspection and other activities shall be conducted in a reasonable mannerwithout a warrant at any reasonable daylight hours falling between sunriseand sunset.

3. Any judge of this state may, within his jurisdiction, and uponproper cause shown, issue a warrant giving the department the right ofentry to any premises for the purpose of carrying out the provisions ofthis section or other activities authorized by sections 263.500 to 263.537.
