Exemptions.

281.250. 1. The penalties provided for violations ofsubsection 1 of section 281.240 shall not apply to:

(1) Any carrier while lawfully engaged in transporting apesticide within this state if such carrier shall, upon request,permit the director or his designated agent to copy all recordsshowing the transactions in and movement of the pesticides;

(2) Public officials of this state and the federalgovernment engaged in the performance of their official duties;

(3) The manufacturer or shipper of a pesticide forexperimental use only:

(a) By or under the supervision of an agency of this stateor of the federal government authorized by law to conductresearch in the field of pesticides; or

(b) By others if the pesticide is not sold and if thecontainer thereof is plainly and conspicuously marked "Forexperimental use only--Not to be sold", together with themanufacturer's name and address; provided, however, that if awritten permit has been obtained from the director, pesticidesmay be sold for experimental purposes subject to suchrestrictions and conditions as may be set forth in the permit.

2. No article shall be deemed in violation of sections281.210 to 281.310 when intended solely for export to a foreigncountry and when prepared or packed according to thespecifications or directions of the purchaser. If not soexported, all the provisions of sections 281.210 to 281.310 shallapply.
