Federal funds, how used--reimbursement, when authorized.

288.320. 1. All moneys received pursuant to section 302 ofthe Federal Social Security Act (42 U.S.C.A. Sec. 502), asamended, shall be expended solely for the purposes and in theamounts necessary for the proper and efficient administration ofthe employment security law.

2. The state of Missouri hereby recognizes its obligation toreplace in the unemployment compensation administration fundwithin a reasonable time, moneys received pursuant to section 302of the Federal Social Security Act (42 U.S.C.A. Sec. 502), asamended, which have been lost or been expended for purposes otherthan or in amounts in excess of those found necessary by theSecretary of Labor for the proper administration of theemployment security law, and that moneys received pursuant tosaid provision of the Social Security Act shall be expendedsolely for the purposes and in the amounts found necessary by theSecretary of Labor for the proper and efficient administration ofthe law.

3. If in the actual administration of the employmentsecurity law, a conflict develops between the provisions of thissection and the provisions of section 288.340, the division ishereby directed to pursue appropriate means to test theconstitutionality of section 303(a)(8) and (9) of the FederalSocial Security Act (42 U.S.C.A. Sec. 503), it being theintention of this legislature that the provisions of thissubsection shall be effective only so long as its provisions arein fact and law required in order that this state may continue toreceive grants of funds to pay the cost of administering theemployment security law.
