Honorable discharge from the military special license plates,application, fee.

301.3054. 1. Any person who served in the active military service ina branch of the armed services of the United States and was honorablydischarged from such service may apply for special personalized licenseplates for any vehicle other than an apportioned motor vehicle or acommercial motor vehicle licensed in excess of eighteen thousand poundsgross weight. Any such person shall make application for the speciallicense plates on a form provided by the director of revenue and furnishsuch proof of service and status as an honorably discharged veteran as thedirector may require.

2. Upon presentation of proof of eligibility and payment of a fifteendollar fee in addition to the regular registration fees, and presentationof any documents which may be required by law, the director shall issue tothe vehicle owner special personalized license plates with the words "U.S.VET" in place of the words "SHOW-ME STATE". Such license plates shall bemade with fully reflective material with a common color scheme and design,shall be clearly visible at night, shall have a reflective white backgroundwith a blue and red configuration in the area of the plate configuration,and shall be aesthetically attractive, as prescribed by section 301.130.Notwithstanding the provisions of section 301.144, no additional fee shallbe charged for the personalization of license plates pursuant to thissection.

There shall be no limit on the number of license plates any personqualified under this section may obtain so long as each set of licenseplates issued under this section is issued for vehicles owned solely orjointly by such person. License plates issued pursuant to this sectionshall not be transferable to any other person except that any registeredco-owner of the vehicle may operate the vehicle for the duration of theregistration in the event of the death of the qualified person. Thedirector of revenue shall make necessary rules and regulations for theenforcement of this section, and shall design all necessary forms requiredby this section. Any rule or portion of a rule, as that term is defined insection 536.010, RSMo, that is created under the authority delegated inthis section shall become effective only if it complies with and is subjectto all of the provisions of chapter 536, RSMo, and, if applicable, section536.028, RSMo. This section and chapter 536, RSMo, are nonseverable and ifany of the powers vested with the general assembly pursuant to chapter 536,RSMo, to review, to delay the effective date, or to disapprove and annul arule are subsequently held unconstitutional, then the grant of rulemakingauthority and any rule proposed or adopted after August 28, 2004, shall beinvalid and void.
