Personal protective equipment, standards for purchasing.

320.088. 1. No fire protection district, volunteer fireprotection association or any fire department of any politicalsubdivision shall purchase any new personal protection equipmentfor structural firefighters unless such equipment meets thestandards established in this section. The state fire marshalshall not purchase any equipment covered under this sectionunless such standards are met.

2. The mandatory minimum standards for all new purchases ofpersonal protective equipment for structural firefighters shallmeet those standards adopted by the National Fire ProtectionAssociation (NFPA). Where no standards exist, the OccupationalSafety and Health Administration (OSHA) fire brigades standards,29 CFR 1910.156, shall apply until an NFPA standard is adopted.

3. Nothing contained in this section shall be construed torequire any fire protection district, volunteer fire protectionassociation or any fire department of any political subdivisionto purchase new equipment of any kind or type.
