Unlawful practices, injunction procedure.

334.230. l. Upon application by the board, and thenecessary burden having been met, a court of general jurisdictionmay grant an injunction, restraining order or other order as maybe appropriate to enjoin a person from:

(1) Offering to engage or engaging in the performance of anyacts or practices for which a certificate of registration orauthority, permit or license is required by this chapter upon ashowing that such acts or practices were performed or offered tobe performed without a certificate of registration or authority,permit or license; or

(2) Engaging in any practice or business authorized by acertificate of registration or authority, permit or licenseissued pursuant to this chapter upon a showing that the holderpresents a substantial probability of serious danger to thehealth, safety or welfare of any resident of the state or clientor patient of the licensee.

2. Any such action shall be commenced either in the countyin which such conduct occurred or in the county in which thedefendant resides.

3. Any action brought under this section shall be inaddition to and not in lieu of any penalty provided by thischapter and may be brought concurrently with other actions toenforce this chapter.
