334.400. Definitions.

Definitions.

334.400. As used in sections 334.400 to 334.430, the following termsshall mean:

(1) "Anesthesiologist", a physician who has completed a residency inanesthesiology approved by the American Board of Anesthesiology or theAmerican Osteopathic Board of Anesthesiology;

(2) "Anesthesiologist assistant", a person who meets each of thefollowing conditions:

(a) Has graduated from an anesthesiologist assistant programaccredited by the American Medical Association's Committee on Allied HealthEducation and Accreditation or by its successor agency;

(b) Has passed the certifying examination administered by theNational Commission on Certification of Anesthesiologist Assistants;

(c) Has active certification by the National Commission onCertification of Anesthesiologist Assistants; and

(d) Provides health care services delegated by a licensedanesthesiologist;

(3) "Anesthesiologist assistant supervision agreement", a writtenagreement, jointly agreed upon protocols or standing order between asupervising anesthesiologist and an anesthesiologist assistant, whichprovides for the delegation of health care services from a supervisinganesthesiologist to an anesthesiologist assistant and the review of suchservices;

(4) "Applicant", any individual who seeks to become licensed as ananesthesiologist assistant;

(5) "Continuing education", the offering of instruction orinformation to license holders for the purpose of maintaining or increasingskills necessary for the safe and competent practice of anesthetic care;

(6) "Department", the department of insurance, financial institutionsand professional registration or a designated agency thereof;

(7) "Immediately available", in the same physical location orfacility in which the services are provided;

(8) "Physician", an individual licensed pursuant to this chapter topractice medicine and surgery or osteopathic medicine and surgery;

(9) "Supervision", medical direction by an anesthesiologist of ananesthesiologist assistant as defined in conditions of 42 CFR 415.110 whichlimits supervision to no more than four anesthesiologist assistantsconcurrently.
