Anesthesiologist assistant, use of title permitted, when--penalty.

334.428. 1. No person shall put forth to the public any title ordescription that includes the words "licensed anesthesiologist assistant"as defined in section 334.404 unless the person is duly licensed pursuantto the provisions of sections 334.400 to 334.430.

2. Nothing in sections 334.400 to 334.430 shall be construed asprohibiting any individual, regardless of whether the individual islicensed pursuant to sections 334.400 to 334.430, from providing theservices of anesthesiologist assistant, so long as those services arelawfully performed pursuant to the individual's scope of practice asauthorized by law, regulation, and hospital or medical staff policies orcredentialing standards.

3. Notwithstanding the specified penalty in section 334.414, anyperson found guilty of violating any provision of subsections 1 and 2 ofthis section shall be guilty of an infraction and upon conviction thereofshall be punished as provided by law. For purposes of this subsection, themaximum fine for a violation of this section shall be two hundred dollars.
