Inspection of records, by whom--credit reporting, allowed when.

369.099. 1. Every member and every stockholder may inspectsuch books and records of an association as pertain to suchperson's loan or account. Otherwise, the right of inspection andexamination of the books and records shall be limited to:

(1) The director of the division of finance or thedirector's duly authorized representatives as provided insections 369.010 to 369.369;

(2) Persons duly authorized to act for the association; and

(3) The Office of Thrift Supervision or any successorthereto, Federal Deposit Insurance Corporation or any successorthereto, or other such insurer of the accounts of theassociation, any federal home loan bank, or savings and loansupervisory authorities located in other states in which anassociation maintains an office.

2. The books and records pertaining to the accounts andloans of account holders, borrowers, and stockholders shall bekept confidential by the association, its directors, officers andemployees, and by the director of the division of finance, thedirector's examiners and representatives, except where thedisclosure thereof is authorized or directed by subsection 1 ofthis section. No person shall be furnished or shall possess apartial or complete list of the members except upon expressaction and authority of the board of directors.

3. An association may report credit information concerningborrowers of the association, and concerning borrowers whoseloans the association is servicing for others, to a consumerreporting agency, as defined by the Fair Credit Reporting Act,Title VI of the Consumer Credit Protection Act of 1968 asamended, and to other lenders in connection with a transactioninvolving a borrower.

4. Stockholders in capital stock associations shall havethe right to examine as prescribed in section 351.215, RSMo, butno stockholder or other person shall have the right to inspectthe records of account holders or borrowers other than suchperson's own account except as provided in subsections 1 and 2 ofthis section.
