374.070. 1. The office shall be a public office and the recordsshall be public records and shall at all times be open to the inspection ofthe public subject to such rules as the director shall make for theirsafekeeping; provided, however, that the work product of the director, thedirector's employees and agents, including but not limited to work papersof examinations of companies, work papers of investigations of insurancecompanies and producers and other persons licensed or with a certificate ofauthority under this chapter, chapter 354, RSMo, and chapters 375 to 385,RSMo, or of other entities as provided by law and confidentialcommunications to the director, shall not be considered public recordsexcept as provided by law.

2. When requested, the director shall furnish certified copies of anypaper, report, or documents on file in the director's office to any personrequesting them, upon payment of the fees allowed by law.

3. Five years after the conclusion of the transactions to which theyrelate, the director is authorized to destroy or otherwise dispose of allcorrespondence, complaints, claim files, working papers of examinations ofcompanies, examination reports of companies made by the insurancesupervisory officials of states other than Missouri, rating files, void orobsolete or superseded rate filings and schedules, individual companyrating experience data, applications, requisitions, and requests forlicenses, all license cards and records, all expired bonds, all records ofhearings, and all similar records, papers, documents, and memoranda now orhereafter in the possession of the director.

4. Ten years after the conclusion of the transactions to which theyrelate, the director is authorized to destroy or otherwise dispose of allforeign companies' and alien companies' annual statements, valuationreports, tax reports, and all similar records, papers, documents andmemoranda now or hereafter in the possession of the director.

5. Disposal and destruction of records shall be in accordance withsections 109.200 to 109.310, RSMo.
