Violations, penalties.

376.1532. 1. If the director determines that a person has engaged, isengaging, or has taken a substantial step toward engaging in a violation ofsections 376.1500 to 376.1532, or a rule adopted or order issued pursuantthereto, or that a person has materially aided or is materially aiding an act,practice, omission, or course of business constituting a violation of sections376.1500 to 376.1532 or a rule adopted or order issued pursuant thereto, thedirector may issue such administrative orders as authorized under section374.046, RSMo. A violation of sections 376.1500 to 376.1532 is a level twoviolation under section 374.049, RSMo. The director of the department ofinsurance, financial institutions and professional registration may alsosuspend or revoke the license or certificate of authority of such person forany willful violation.

2. If the director believes that a person has engaged, is engaging, orhas taken a substantial step toward engaging in a violation of sections376.1500 to 376.1532 or a rule adopted or order issued pursuant thereto, orthat a person has materially aided or is materially aiding an act, practice,omission or course of business constituting a violation of sections 376.1500to 376.1532 or a rule adopted or order issued pursuant thereto, the directormay maintain a civil action for relief authorized under section 374.048, RSMo. A violation of sections 376.1500 to 376.1532 is a level two violation undersection 374.049, RSMo.
