Rate increases over fifteen percent prohibited without notice,exception.

383.209. Notwithstanding any other provision of law, no insurershall, with regards to medical malpractice insurance, as defined in section383.150, implement any rate increase of more than fifteen percent withoutfirst providing clear and conspicuous written notice by United States mailto the insured at least sixty days prior to implementation of the rateincrease, unless the increase is due to the request of the insured or dueto a material change in the nature of the insured's health care practice orindividual's risk characteristics.
