Mishandling records--false statements--penalty--order provisions.

386.560. Any person who shall willfully make any false entryin the accounts, books of account, records or memoranda kept byany corporation, person or public utility governed by theprovisions of this chapter, or who shall willfully destroy,mutilate, alter or by any other means or device falsify therecord of any such account, book of accounts, record ormemoranda, or who shall willfully neglect or fail to make full,true and correct entries of such account, book of accounts,record or memoranda of all facts and transactions appertaining tothe business of such corporations, persons or public utilities,or who shall falsely make any statement required to be made tothe public service commission, in which a penalty has notheretofore been provided for, shall be deemed guilty of a felony,and upon conviction shall be punished by a fine of not less thanone thousand dollars nor more than five thousand dollars, or byimprisonment for not less than two years nor more than fiveyears, or by both such fine and imprisonment; provided, that thecommission may, in its discretion, issue orders specifying suchoperating, accounting or financial papers, records, books,blanks, tickets, stubs or documents, of carriers which may aftera reasonable time be destroyed, and prescribing the length oftime such books, papers or documents shall be preserved; andprovided further, that such orders shall be in harmony with thoseof the Interstate Commerce Commission.
