Furnishing of supplies prohibited, when.

388.130. 1. No president, director, officer, agent oremployee of any railroad company, or other corporation operatinga railroad, shall hereafter be interested in any manner, directlyor indirectly, in furnishing materials or supplies to suchcompany; nor shall any such officer, agent or employee of anyrailroad company, or other corporation owning, controlling ormanaging a railroad, be interested, directly or indirectly, inthe business of transportation as a common carrier of freight orpassengers over the works owned, leased, controlled or operatedby the corporation or association of which he is an officer,agent or employee.

2. Any president, director, officer, agent or employee ofany such railroad company who shall violate any of the provisionsof this section shall be deemed guilty of a misdemeanor, and uponconviction thereof shall be fined in a sum of not less than twohundred dollars nor more than one thousand dollars, or byimprisonment in the county jail for a term of not less than threemonths nor more than one year, or by both such fine andimprisonment, and each day any such violation continues shall bea separate offense.
