Right of trustees to change roadbed or roadline and toacquire right-of-way.

388.440. Trustees or receivers of railroad companies andcorporations and their estates appointed by any court whatsoever,owning, holding, operating, controlling or managing any suchcorporation or company or its estate shall have the right andpower at any time to change the roadbed or roadline of thecorporation or company or estate for which they were appointedtrustees or receivers and which they are owning, holding,operating, controlling or managing, or any part of such roadbedor roadline, for the purpose of shortening the line or toovercome natural objections thereto or to secure economy in itsconstruction or maintenance, and shall have the right and powerto take and hold all necessary ground for right-of-way for suchchanges, and if the title thereof cannot be secured by agreementwith the owners thereof, or if for any other cause the titlecannot be secured, such trustees or receivers may proceed tocondemn the same in the same manner and with the same effect asis now provided by law for the condemnation of lands by railroadcorporations.
