Division of motor carrier and railroad safety required to promulgaterules for electronic filing of certificates of insurance by insurancecompanies--confirmation of coverage and acceptance of proof ofnonresident insurance may be provided.

390.128. 1. To assist motor carriers in certifying their motorvehicle financial responsibility as required pursuant to this chapter andchapter 622, RSMo, the division of motor carrier and railroad safety withinthe state department of economic development shall provide by rule for theelectronic filing by insurance companies of certificates of insurancerequired by section 390.126, RSMo. The division may provide by rule forthe confirmation of coverage by insurance companies authorized to dobusiness in the state through national clearinghouses or private databases.The division may provide by rule for the acceptance of proof of insurancefrom insurance companies located outside of the state.

2. Any rule or portion of a rule, as that term is defined in section536.010, RSMo, that is created under the authority delegated in thissection shall become effective only if it complies with and is subject toall of the provisions of chapter 536, RSMo, and, if applicable, section536.028, RSMo. This section and chapter 536, RSMo, are nonseverable and ifany of the powers vested with the general assembly pursuant to chapter 536,RSMo, to review, to delay the effective date or to disapprove and annul arule are subsequently held unconstitutional, then the grant of rulemakingauthority and any rule proposed or adopted after August 28, 2000, shall beinvalid and void.
