Transitionally competitive telecommunications services, classifiedwhen.

392.370. After the effective date of an order of the commission whichfinds, pursuant to section 392.361, that a telecommunications service issufficiently competitive to justify a lesser degree of regulation, thesame, substitutable, or equivalent service offered by a transitionallycompetitive or noncompetitive telecommunications company shall beclassified as transitionally competitive, if the telecommunications servicegranted a lesser degree of regulation is authorized to be provided anywherewithin the certificated or service area of the transitionally competitiveor noncompetitive telecommunications company. Any transitionallycompetitive telecommunications service offered by a noncompetitive localexchange telecommunications company shall be classified as a competitivetelecommunications service no later than three years after the effectivedate of a tariff for such service bearing the classification"transitionally competitive". Any transitionally competitive serviceoffered by a transitionally competitive interexchange telecommunicationscompany shall be classified as a competitive telecommunications service nolater than two years after the effective date of a tariff for such servicebearing the classification "transitionally competitive". The exchangeaccess rates of an incumbent local exchange company that is declared acompetitive telecommunications company shall not exceed the rates that werecharged at the time the company became a competitive telecommunicationscompany. The exchange access rates of an alternative local exchangecompany shall not exceed the exchange access rates of the incumbent localexchange company against whom the alternative local exchange company iscompeting.
