Penalties.

407.436. 1. Any person who willfully and knowingly, andwith the intent to defraud, engages in any practice declared tobe an unlawful practice in sections 407.430 to 407.436 of thiscredit user protection law shall be guilty of a class D felony.

2. The violation of any provision of sections 407.430 to407.436 of this credit user protection law constitutes anunlawful practice pursuant to sections 407.010 to 407.130, andthe violator shall be subject to all penalties, remedies andprocedures provided in sections 407.010 to 407.130. The attorneygeneral shall have all powers, rights, and duties regardingviolations of sections 407.430 to 407.436 as are provided insections 407.010 to 407.130, in addition to rulemaking authorityas provided in section 407.145.
