Assignee may apply for discharge, when and how.

426.350. When any assignee becomes satisfied that it is nolonger advantageous to the creditors of his assignor to keep theassignment open, he may apply to the circuit court in whoseclerk's office the inventory is filed for a discharge from histrust, upon a notice of his intention to make such application,stating the time thereof, which notice shall be published in thenewspaper aforesaid, for at least six weeks next before suchtime, at which time he may file his petition in said court forsuch discharge; which petition, verified by his affidavit, shallset forth the disposition made of the assets of the assignment tohim; what portion of them remains on hand, and their condition;the amount realized from the assets; the particular dispositionof such amount; the demands allowed, particularly, with theirrespective amounts and owners' names, and the sums paid on each,with an offer to deliver into the charge of the court whatremains of the assets and the evidence thereof, and accompaniedwith all vouchers therewith connected.
