Witnesses, subpoenas, depositions.

435.380. 1. The arbitrators may issue or cause to be issuedsubpoenas for the attendance of witnesses and for the productionof books, records, documents and other evidence, and shall havethe power to administer oaths. Subpoenas so issued shall beserved, and upon application to the court by a party or thearbitrators, enforced, in the manner provided by law for theservice and enforcement of subpoenas in a civil action.

2. On application of a party and for use as evidence, thearbitrators may permit a deposition to be taken, in the mannerand upon the terms designated by the arbitrators, of a witnesswho cannot be subpoenaed or is unable to attend the hearing.

3. All provisions of law compelling a person under subpoenato testify are applicable.

4. Fees for attendance as a witness shall be the same as fora witness in the circuit court.
