Processing fee, annual permit fee--metallic minerals waste managementfund, created, uses.

444.370. 1. A processing fee of ten thousand dollars shallaccompany the filing of the application for a facility ormetallic minerals waste management area. An annual fee of seventhousand five hundred dollars per facility or metallic mineralswaste management area shall be paid when the permit is approvedand on each anniversary date thereafter until the determinationis made that inspection-maintenance is no longer required.

2. All sums received through the payment of fees or theforfeiture of bonds pursuant to sections 444.352 to 444.380 shallbe placed in the state treasury and credited to the "MetallicMinerals Waste Management Fund" which is hereby created.

3. After appropriations by the general assembly, the moneyin this fund shall be expended for the administration andenforcement of sections 444.352 to 444.380 and for any otherpurpose directly related to effective management of remediationof a metallic minerals waste management area. Any portion of thefund not immediately needed for the purposes authorized shall beinvested by the state treasurer as provided by the constitutionand laws of this state. All income from such investments shallbe deposited in the metallic minerals waste management fund. Theprovisions of section 33.080, RSMo, to the contrarynotwithstanding, moneys in the fund shall not lapse to generalrevenue until the amount in the fund is in excess of threemillion dollars, exclusive of the interest and securityforfeiture proceeds.

4. The moneys collected from any forfeiture of a financialassurance instrument shall be expended upon the area for whichthe permit was issued and for which the instrument was given.

5. General revenue of the state may be appropriated for orexpended only for the administration and enforcement of sections444.352 to 444.380.
