Commission authorized to receive funds and services.

444.740. 1. In the reclamation of land affected by stripmining for which it has funds available, the commission may availitself of any services which may be provided by other stateagencies or by agencies of the federal government, and maycompensate them for such services.

2. The commission may receive any federal funds, state fundsor any other funds for the reclamation of land affected by stripmining. The commission may cause the reclamation work to be doneby its own employees or by the employees of other governmentalagencies, soil conservation districts, or through contracts withqualified persons. The contracts shall be awarded to the lowestresponsible bidder upon competitive bids after reasonableadvertisement. The commission and any other agency and anycontractor under a contract with the board shall have reasonableright of access to the land affected to carry out suchreclamation.

3. When funds or any public works program are available tothe commission, both funds and services may be used and expendedto reclaim and rehabilitate any lands that have been subjected tostrip mining that have not been reclaimed and rehabilitated inaccordance with standards set by sections 444.500 to 444.755 andwhich are not covered by bond to guarantee such reclamation.

4. A person or organization having qualifications acceptableto the commission may post bond or a cash deposit in a sumdetermined by the commission and assume the liability forcarrying out the reclamation plan approved by the commission inareas where the mining operation and any necessary grading havebeen completed. The commission shall then release the bondposted by the operator for such area.
