Report on fund required--administration of fund, rules andregulations--authorized activities--water pollution treatment.

444.940. 1. Not later than January 1, 1981, and annuallythereafter, the commission shall report to the Congress and thegeneral assembly on operations under the abandoned minereclamation fund together with recommendations as to future usesof the abandoned mine reclamation fund.

2. The commission shall have the power and authority, if notgranted it otherwise, to engage in any work and to do all thingsnecessary or expedient, including promulgation of rules andregulations, to implement and administer the abandoned minereclamation fund.

3. The commission shall have the power and authority toengage in cooperative projects under this title with any agencyof the United States of America, and any state and theirgovernmental agencies to administer the abandoned minereclamation fund.

4. The commission may request the attorney general, who ishereby authorized to initiate, in addition to any other remediesprovided for, in any court of competent jurisdiction, an actionin equity for an injunction to restrain any interference with theexercise of the right to enter or to conduct any work provided insections 444.915 to 444.940.

5. The commission shall have the power and authority toconstruct and operate a plant or plants for the control andtreatment of water pollution resulting from mine drainage toimplement and administer the abandoned mine reclamation fund.The extent of this control and treatment may be dependent uponthe ultimate use of the water; provided, that no control ortreatment under this subsection shall in any way be less thanthat required under the Federal Water Pollution Control Act. Theconstruction of a plant or plants may include major interceptorsand other facilities appurtenant to the plant.
