476.690. 1. Any judge who has become eligible to receive retirementcompensation pursuant to section 476.520 and who has elected not to retireand has continued to serve as a judge after August 28, 1995, shall haveadded to the retirement compensation when the judge retires or dies anamount equal to the total of all annual cost-of-living increases thatretired judges received between the time the judge first became eligible toretire and the year the judge actually retires or dies. In no event shallthe total increase in compensation granted pursuant to this section andsection 476.601 exceed sixty-five percent of the judge's retirementcompensation calculated at the time of retirement or death.

2. Any judge who was eligible to retire on August 28, 1995, andelected to continue to serve as a judge after such date, but who retiredbefore August 28, 1996, shall, upon application to the board of trustees ofthe Missouri state employees' retirement system, be made, constituted andappointed and employed by the board as a special consultant on the problemsof retirement, aging and other state matters for the remainder of theperson's life. Upon request of the board or the court from which the judgeretired, the consultant shall give opinions or be available to giveopinions in writing or orally in response to such request. As compensationfor such services, the consultant shall have the retirement benefitrecalculated from the date of the retirement, pursuant to the provisions ofsubsection 1 of this section.

3. Any judge who retired prior to August 28, 1995, and who isreceiving judicial retirement compensation on September 1, 2000, shall uponapplication to the board of trustees of the Missouri state employees'retirement system be made, constituted and appointed and employed by theboard as a special consultant on the problems of retirement, aging andother state matters for the remainder of the judge's life. Upon request ofthe board or the court from which the judge retired, the consultant shallgive opinions or be available to give opinions in writing or orally inresponse to such request. As compensation for such services, theconsultant shall have the consultant's retirement benefit recalculated asif subsection 1 of this section was in effect on the consultant's date ofretirement. Any monthly benefit increases payable pursuant to thissubsection shall become effective September 1, 2000. In no event shall thesystem make any retroactive compensation payments under this subsection.
