Railroad liable for killing stock--irrespective of negligence unlessroad is fenced.

537.260. When any animal or animals shall be killed orinjured by the cars, locomotive or other carriages used on anyrailroad in this state, the owner of such animal or animals mayrecover the value thereof, in an action against the company orcorporation running such railroad, without any proof ofnegligence, unskillfulness or misconduct, on the part of theofficers, servants or agents of such company; but this sectionshall not apply to any accident occurring on any portion of suchroad that may be enclosed by a lawful fence, or in the crossingof any public highway.
