Abandonment of airtight or semi-airtight containers.

577.100. 1. A person commits the crime of abandonment ofairtight icebox if he abandons, discards, or knowingly permits toremain on premises under his control, in a place accessible tochildren, any abandoned or discarded icebox, refrigerator, orother airtight or semiairtight container which has a capacity ofone and one-half cubic feet or more and an opening of fiftysquare inches or more and which has a door or lid equipped withhinge, latch or other fastening device capable of securing suchdoor or lid, without rendering such equipment harmless to humanlife by removing such hinges, latches or other hardware which maycause a person to be confined therein.

2. Subsection 1 of this section does not apply to an icebox,refrigerator or other airtight or semiairtight container locatedin that part of a building occupied by a dealer, warehouseman orrepairman.

3. The defendant shall have the burden of injecting theissue under subsection 2 of this section.

4. Abandonment of an airtight icebox is a class Bmisdemeanor.
