Possession of prescription medication on public or private schoolproperty--exceptions--violations, penalty.

577.628. 1. No person less than twenty-one years of age shallpossess upon the real property comprising a public or private elementary orsecondary school or school bus prescription medication without a validprescription for such medication. For purposes of this section,prescription medication shall not include medication containing acontrolled substance, as defined in section 195.010, RSMo.

2. The provisions of this section shall not apply to any personauthorized to possess a prescription medication by any school personnel whoare responsible for storing, maintaining, or dispensing any prescriptionmedication under chapter 338, RSMo. This section shall not limit the useof any prescription medication by emergency personnel, as defined insection 565.081, RSMo, during an emergency situation.

3. Any person less than twenty-one years of age who violates theprovisions of this section is guilty of a class C misdemeanor for a firstoffense and a class B misdemeanor for any second or subsequent offense.
