Entry by department on public or private property for regulationpurposes--refusal to allow grounds for revocation or injunctions,violations of regulations, penalties.

643.250. 1. Any authorized representative of the departmentmay enter at all reasonable times, in or upon public or privateproperty for purposes required under sections 643.225 to 643.250.Refusal to allow such entry shall be grounds for revocation ofregistration or injunctive relief.

2. Any person who knowingly violates sections 643.225 to643.250, or any rule promulgated thereunder, shall, uponconviction, be punished by a fine of not less than twenty-fivehundred dollars nor more than twenty-five thousand dollars perday of violation, or by imprisonment for not more than one year,or both. Second and successive convictions of any person shallbe punished by a fine of not more than fifty thousand dollars perday of violation, or by imprisonment for not more than two years,or both.

3. Any person who violates any provision of sections 643.225to 643.250 may, in addition to any other penalty provided by law,incur a civil penalty in an amount not to exceed ten thousanddollars for each day of violation. The civil penalty shall be inan amount to constitute an actual and substantial economicdeterrent to the violation for which the civil penalty isassessed. Any civil penalty paid shall be placed in the naturalresources protection fund--*air pollution asbestos fee subaccount*.

4. Notwithstanding the existence or pursuit of any otherremedy provided by sections 643.225 to 643.250, the commissionmay maintain, in the manner provided by chapter 536, RSMo, anaction in the name of the state of Missouri for injunction orother process against any person to restrain or prevent anyviolation of the provisions of sections 643.225 to 643.250.
