Certification of nationwide permit by department, when.
644.038. Where applicable, under Section 404 of the federal CleanWater Act and where the U.S. Army Corps of Engineers has determined that anationwide permit may be utilized for the construction of highways andbridges approved by the Missouri highways and transportation commission,the department shall certify without conditions such nationwide permit asit applies to impacts on all waters of the state.
