Manner of abatement--owner may perform abatement, when.

701.310. 1. Any abatement of the lead hazard from the dwelling orchild-occupied facility shall be performed in a manner so as not toendanger the health of its occupants or persons performing the abatement.

2. To the extent permitted by federal regulations, an individual whois an owner, a partner in a partnership owning, or a corporate officer in acorporation owning a dwelling and who is not licensed pursuant to section701.312 may personally perform lead abatement within a dwelling that he orshe owns, unless the residential dwelling is occupied by a person orpersons other than the owner, or the owner's immediate family while theseactivities are being performed, or a child residing in the building hasbeen identified as having an elevated blood lead level. Prior to beginningsuch abatement, the owner shall consult with the department regarding themost effective method of conducting such lead abatement activities and ofthe proper procedures in performing those activities.
