81-2,272.36. Vending machine dispensing potentially hazardous food; requirements.(1) A vending machine dispensing potentially hazardous food shall have an automatic control that prevents the vending machine from dispensing food:(a) If there is a power failure, mechanical failure, or other condition that results in an internal machine temperature that cannot maintain food temperatures as specified under the Nebraska Pure Food Act; and(b) If a condition specified under subsection (1)(a) of this section occurs, until the vending machine is serviced and restocked with food that has been maintained at temperatures specified under the act.(2) When the automatic shutoff within a vending machine dispensing potentially hazardous food is activated:(a) In a refrigerated vending machine, the ambient temperature shall not exceed forty-one degrees Fahrenheit (five degrees Celsius) or forty-five degrees Fahrenheit (seven degrees Celsius) as specified under the act for more than thirty minutes immediately after the vending machine is filled, serviced, or restocked; or(b) In a hot holding vending machine, the ambient temperature shall not be below one hundred thirty-five degrees Fahrenheit (fifty-seven degrees Celsius) for more than one hundred twenty minutes immediately after the vending machine is filled, serviced, or restocked.
