83-1213. Quality reviewteam; members; expenses;duties; reports.(1) The department shall provide for theestablishment of at least one quality review team for each developmentaldisability service area designated by the department. Eachteam shall consist of at least fourmembers andshall include at least one person with a developmental disability, at leastone parent or other close relative of a person with a developmental disability,and at least one person who is neither a person with a developmental disabilitynor a close relative of such a person. No employee of any governmental agencyor instrumentality or any specialized program shall be eligible to be appointedto a team. Thedepartment shall consider nominations forsuch teams from advocacy groups, providers, elected officials,or other groups or by persons interested in developmental disability serviceswho are located in the service area where such team is established.(2) Members of each quality review team shall be reimbursed by the department for theiractual and necessary expenses as provided in sections 81-1174 to 81-1177.(3)(a) Each quality reviewteam shall (i) conductonsite visits of persons with developmental disabilities receiving residentialservices funded in whole or in part by the department, (ii) assess the qualityof life of such persons receiving such services, (iii) make recommendationsto improve the quality of such services on behalf of such persons, and (iv)perform such advisory or other duties as provided or approved in rules andregulations adopted and promulgated by the department.(b) In makingquality of life assessments of persons receiving such services, the qualityreview team shall consider the extent to which such persons (i) are able toexercise choice and control regarding the type and provider of services theyreceive and the daily activities in which they are engaged, (ii) are treatedwith respect and dignity by their service providers, (iii) have access tonecessary services, equipment, and support, and (iv) are able to participatein activities and events that maximize community integration and inclusion.(4) Each qualityreview team shall provide quarterly and annual written reports to the departmentand service providers of visits conducted and assessments completed underthis section.
