3B:14-3 - Powers and duties of substituted fiduciary

3B:14-3.  Powers and duties of substituted fiduciary    A substituted fiduciary may demand, receive and recover the property and assets of the estate, and maintain all proper actions for the recovery thereof,  and do all acts necessary for the administration and settlement of the estate  and execution of the powers and performance of the trusts contained in the will  or other instrument, in the same manner and to the same effect as if he had  been appointed or named in the first instance. The fiduciary shall in the same  manner be liable for any neglect or failure to perform the duties of his  appointment.
