§1‑567.49.  Determination of rules of procedure.

(a)        Subject to theprovisions of this Article, the parties may agree on the procedure to befollowed by the arbitral tribunal in conducting the proceedings.

(b)        If there is noagreement under subsection (a) of this section, the arbitral tribunal may,subject to the provisions of this Article, conduct the arbitration in suchmanner as it considers appropriate.  The power conferred upon the arbitraltribunal includes the power to order such discovery as it deems necessary andto determine the admissibility, relevance, materiality, and weight of anyevidence.  Evidence need not be limited by the rules of evidence applicable injudicial proceedings, except as to immunities and privilege.  Each party shallhave the burden of proving the facts relied on to support its claim, setoff, ordefense.
