§ 127A‑16.  Governor ascommander in chief.

(a)        The Governor shallbe commander in chief of the militia and shall have power to call out themilitia to execute the laws, secure the safety of persons and property,suppress riots or insurrections, repel invasions and provide disaster relief.

(b)        The Governor shallhave the additional power, subject to the availability of funding, to placeindividuals, units, or parts of units of the North Carolina National Guard in aState Active Duty status to assist with the planning, support, and execution ofactivities connected with the swearing in and installation of the Governor andother members of the Council of State.
