§ 130A‑295.5.  Trafficstudy required for certain solid waste management facilities.

(a)        An applicant for apermit for a sanitary landfill or for a transfer station shall conduct atraffic study of the impacts of the proposed facility. The Department shallinclude as a condition of a permit for a sanitary landfill or for a transferstation a requirement that the permit holder mitigate adverse impactsidentified by the traffic study. The study shall include all of the followingat a minimum:

(1)        Identification ofroutes from the nearest limited access highway used to access the proposedfacility.

(2)        Daily and hourlytraffic volumes that will result along each approach route between the nearestlimited access highway and the proposed facility.

(3)        A map identifyingland uses located along the identified approach routes, including, but notlimited to, residential, commercial, industrial development, and agriculturaloperations. The map shall identify residences, schools, hospitals, nursinghomes, and other significant buildings that front the approach routes.

(4)        Identification oflocations on approach routes where road conditions are inadequate to handle theincreased traffic associated with the proposed facility and a description ofthe mitigation measures proposed by the applicant to address the conditions.

(5)        A description of thepotential adverse impacts of increased traffic associated with the proposedfacility and the mitigation measures proposed by the applicant to address theseimpacts.

(6)        An analysis of theimpact of any increase in freight traffic on railroads and waterways.

(b)        An applicant for apermit for a sanitary landfill or for a transfer station may satisfy therequirements of subsection (a) of this section by obtaining a certificationfrom the Division Engineer of the Department of Transportation that theproposed facility will not have a substantial impact on highway traffic.
