§133‑11.  Relocation assistance advisory services.

(a)        Programs orprojects undertaken by an agency shall be planned in a manner that (1)recognizes, at any early stage in the planning of such programs or projects andbefore the commencement of any actions which will cause displacements ofindividuals, families, businesses, and farm operations, and (2) provides forthe resolution of such problems in order to minimize adverse impacts ondisplaced persons and to expedite program or project advancement and completion.

(b)        Agencies shallensure that the relocation assistance advisory services described in subsection(c) of this section are made available to all persons displaced by suchagency.  If such agency determines that any person occupying property immediatelyadjacent to the property where the displacing activity occurs sufferssubstantial economic injury as a result thereof, the agency may make suchadvisory services available to that person.

(c)        Each relocationassistance advisory program required by subsection (b) of this section shallinclude such measures, facilities, or services as may be necessary orappropriate in order to:

(1)        Determine, and maketimely recommendations on, the needs and preferences, if any, of displacedpersons for relocation assistance;

(2)        Provide current andcontinuing information on the availability, sales prices, and rental charges ofcomparable replacement dwellings for displaced homeowners and tenants andsuitable locations for businesses and farm operations;

(3)        Assist a persondisplaced from a business or farm operation in obtaining and becomingestablished in a suitable replacement location;

(4)        Supply (i)information concerning federal, State, and local programs which may be ofassistance to displaced persons, and (ii) technical assistance to such personsin applying for assistance under such programs;

(5)        Provide otheradvisory services to displaced persons in order to minimize hardships to suchpersons in adjusting to relocation; and

(6)        The agency shallcoordinate relocation activities performed by such agency with other federal,State, or local governmental actions in the community which could affect theefficient and effective delivery of relocation assistance and related services.

(d)        NotwithstandingG.S. 133‑7(3)b, in any case in which a displacing agency acquiresproperty for a program or project, any person who occupies such property on arental basis for a short term or a period subject to termination when theproperty is needed for the program or project shall be eligible for advisoryservices to the extent determined by the agency.
