§ 156‑37.  Petition filed in superior court.

Any proprietor in fee of swamplands, which cannot be drained except bycutting a canal through the lands of another or other proprietor in fee,situated at a lower level and which would also be materially benefited by thecutting of such canal, who desires that such canal be cut on the terms on whichit is hereinafter allowed, may apply by petition, setting forth the facts, tothe superior court of the county in which any of the lands through which thecanal will pass may lie.
