§25‑2‑317.  Cumulation and conflict of warranties express orimplied.

Warranties whether express orimplied shall be construed as consistent with each other and as cumulative, butif such construction is unreasonable the intention of the parties shall determinewhich warranty is dominant. In ascertaining that intention the following rulesapply:

(a)        Exact or technicalspecifications displace an inconsistent sample or model or general langauge ofdescription.

(b)        A sample from anexisting bulk displaces inconsistent general language of description.

(c)        Express warrantiesdisplace inconsistent implied warranties other than an implied warranty offitness for a particular purpose. (1965, c. 700, s. 1.)
