§58‑21‑100.  Actions against surplus lines insurer; service ofprocess.

(a)        A surplus linesinsurer may be sued upon any cause of action arising in this State, under anysurplus lines insurance contract made by it or evidence of insurance issued ordelivered by the surplus lines licensee, pursuant to the procedure provided inG.S. 58‑16‑30.  Any such policy issued by the surplus lineslicensee shall contain a provision stating the substance of this section anddesignating the person to whom the Commissioner shall mail process.

(b)        Each surplus linesinsurer engaging in surplus lines insurance shall be deemed thereby to havesubjected itself to this Article.

(c)        The remedies andprocedures provided in this section are in addition to any other methodsprovided by law for service of process upon insurers. (1985,c. 688, s. 1; 1991, c. 720, s. 43.)
