§ 58‑33‑31. Application for license.

(a)        A person applyingfor a resident insurance producer license shall make application to theCommissioner on the Uniform Application and declare under penalty of denial,suspension, or revocation of the license that the statements made in theapplication are true, correct, and complete to the best of the individual'sknowledge and belief. Before approving the application, the Commissioner shallfind that the individual:

(1)        Is at least 18 yearsof age.

(2)        Has not committedany act that is a ground for probation, suspension, nonrenewal, or revocationset forth in G.S. 58‑33‑46.

(3)        Has satisfied anyapplicable requirements of G.S. 58‑33‑30(d).

(4)        Has paid theapplicable fees set forth in G.S. 58‑33‑125.

(5)        Has successfullypassed any examinations required by G.S. 58‑33‑30(e).

(b)        A business entityselling, soliciting, or negotiating insurance shall obtain an insuranceproducer license. Application shall be made using the Uniform Business EntityApplication. Before approving the application, the Commissioner shall findthat:

(1)        The business entityhas paid the applicable fees set forth in G.S. 58‑33‑125.

(2)        The business entityhas designated a licensed producer, who is a natural person, responsible forthe business entity's compliance with the insurance laws and administrativerules of this State and orders of the Commissioner.

(c)        The Commissionermay require any documents reasonably necessary to verify the informationcontained in an application. (2001‑203, s. 12.)
