§58‑36‑60. Payment of dividends not prohibited or regulated; planfor payment into rating system.
Nothing in this Article willbe construed to prohibit or regulate the payment of dividends, savings, orunabsorbed premium deposits allowed or returned by insurers to theirpolicyholders, members, or subscribers. Individual policyholder lossexperience may be considered as a factor in determining dividends for workers'compensation insurance and employers' liability insurance written in connectiontherewith. A plan for the payment of dividends, savings, or unabsorbed premiumdeposits allowed or returned by insurers to their policyholders, members, orsubscribers will not be deemed a rating plan or system.
