§ 58‑44‑90. Mediation fees.
(a) The fees of themediator and of the Administrator as established by the Commissioner shall beborne by the insurer. All other mediation costs, fees, or expenses shall beborne by the party incurring such costs, fees, or expenses unless otherwiseprovided in a settlement agreement.
(b) The Commissionermay establish fee schedules, through emergency rules, for fees to be paid tothe Administrator, the mediator, and for timely and untimely mediationcancellations. (2006‑145,s. 1.)
