§ 58‑71‑50. Qualification for bail bondsmen and runners.

(a)        Criminal HistoryRecord Check. – Upon receipt of an application for a license as a bail bondsmanor runner, the Commissioner shall conduct a criminal history record check inaccordance with G.S. 58‑71‑51 to determine whether the applicantmeets the requirements for a license as provided in this section.

(b)        Qualifications. – Everyapplicant for a license under this Article as a bail bondsman or runner mustmeet all of the following qualifications:

(1)        Be 18 years of ageor over.

(1a)      Have obtained a highschool diploma or its equivalent.

(2)        Be a resident ofthis State.

(3)        Repealed by SessionLaws 1998‑211, s. 23, effective November 1, 1998.

(4)        Have knowledge,training, or experience of sufficient duration and extent to provide thecompetence necessary to fulfill the responsibilities of a licensee.

(5)        Have no outstandingbail bond obligations.

(6)        Have no current orprior violations of any provision of this Article or of Article 26 of Chapter15A of the General Statutes or of any similar provision of law of any otherstate.

(7)        Not have been in anymanner disqualified under the laws of this State or any other state to engagein the bail bond business.

(8)        Hold a valid andcurrent North Carolina drivers license or valid North Carolina identificationcard issued by the Division of Motor Vehicles.

(c)        Proof of Residency.– An applicant for a license as a bail bondsman or runner shall provide to theCommissioner at least two of the documents listed in this subsection as proofof residency in this State. Subject to rules adopted by the Commissioner, anapplicant may be required to provide additional documentation. The permissibledocuments are:

(1)        A pay stub showingthe applicant's residential address in this State.

(2)        A utility billshowing the applicant's residential address in this State.

(3)        A written leaseagreement or contract for purchase and sale signed by the applicant and for aresidence located in this State.

(4)        A receipt forpersonal property taxes paid by the applicant to a North Carolina unit of localgovernment.

(5)        A receipt for realproperty taxes paid by the applicant to a North Carolina unit of localgovernment.
