§6‑23.  Defendant unreasonably defending after notice of no personal claimto pay costs.

In case of a defendant,against whom no personal claim is made, the plaintiff may deliver to suchdefendant with the summons, a notice subscribed by the plaintiff or hisattorney, setting forth the general object of the action, a brief descriptionof the property affected by it, if it affects real or personal property, andthat no personal claim is made against such defendant. If a defendant on whomsuch notice is served unreasonably defends the action, he shall pay costs tothe plaintiff. (Code, s. 216; Rev., s. 1270; C.S., s. 1246.)
