§ 7A‑41.  Superior courtdivisions and districts; judges.

(a)        (Effective untilJanuary 1, 2011)  The counties of the State are organized into judicialdivisions and superior court districts, and each superior court district hasthe counties, and the number of regular resident superior court judges setforth in the following table, and for districts of less than a whole county, asset out in subsection (b) of this section:

(10a)    Effective with the2004 election, in addition to the boundaries provided for in this section,Superior Court District 14A also includes that portion of Durham Precinct 53east of North Carolina Highway #751.

(11)      Superior CourtDistrict 14B consists of the remainder of Durham County not in Superior CourtDistrict 14A. It has three judges.

(12)      Superior CourtDistrict 18A consists of Fentress Precincts 1 and 2; Greensboro Precincts 4, 5,6, 46, 52, 67, 68, 69, 70, 71, 72, 73, 74, and 75; North Clay Precinct;Pleasant Garden Precincts 1 and 2; and South Clay Precinct. It has one judge.

(28)      Superior CourtDistrict 5C consists of the part of New Hanover County that is not in SuperiorCourt Districts 5A or 5B. It has one judge.

(c)        In subsection (b)above:

(1)        The names andboundaries of townships are as they were legally defined and in effect as ofJanuary 1, 1980, and recognized in the 1980 U.S. Census;

(2)        For Guilford County,the precincts are as they were legally defined and recognized as votingdistricts of the same name in the 2000 U.S. Census, except Greensboro Precincts40A and 40B are as they were modified by the Guilford County Board of Electionsand are as shown on the Legislative Services Office's redistricting computer databaseon May 1, 2001;

(2a)      For Wake County, theprecincts are as they were adopted by the Wake County Board of Elections and ineffect as of January 1, 2001;

(3)        For Mecklenburg andDurham Counties, precinct boundaries are as shown on the current maps in use bythe appropriate county board of elections as of January 31, 1984, in accordancewith G.S. 163‑128(b);

(4)        For Wilson County,commissioner districts are those in use for election of members of the countyboard of commissioners as of January 1, 1987;

(5)        For CumberlandCounty, House District 17 is in accordance with the boundaries in effect onJanuary 1, 1987. Precincts are in accordance with those as approved by theUnited States Department of Justice on February 28, 1986; and

(6)        For Forsyth County, theprecincts are as they were legally defined and recognized in the 2000 U.S.Census as of January 1, 2001; and

(7)        The names andboundaries of precincts in Montgomery, Moore, and Randolph Counties are thosein existence on March 15, 1999.

(8)        The names andboundaries of precincts in New Hanover and Pender Counties are those inexistence on December 1, 1999.

If any changes in precinctboundaries, wards, commissioner districts, or House of Representative districtshave been made since the dates specified, or are made, those changes shall notchange the boundaries of the superior court districts; provided that if any ofthose boundaries have changed, a precinct is divided by a superior courtjudicial district boundary, and the precinct was not so divided at the time ofenactment of this section in 1987, the boundaries of the superior courtjudicial district are changed to place the entirety of the precinct in thesuperior court judicial district where the majority of the residents of theprecinct reside, according to the 1990 Federal Census if:

(1)        Such change does notresult in placing a superior court judge in another superior court district;

(2)        Such change does notmake a district that has an effective racial minority electorate not have aneffective racial minority electorate; and

(3)        The change isapproved by the county board of elections where the precinct is located, StateBoard of Elections and by the Secretary of State upon finding that the change:

a.         Will improveelection administration; and

b.         Complies withsubdivisions (1) and (2) of this subsection.

(d)        The several judges,their terms of office, and their assignments to districts are as follows:

(1)        In the firstsuperior court district, J. Herbert Small and Thomas S. Watts serve termsexpiring December 31, 1994.

(2)        In the secondsuperior court district, William C. Griffin serves a term expiring December 31,1994.

(3)        In the third‑Asuperior court district, David E. Reid serves a term expiring on December 31,1992.

(4)        In the third‑Bsuperior court district, Herbert O. Phillips, III, serves a term expiring onDecember 31, 1994.

(5)        In the fourth‑Asuperior court district, Henry L. Stevens, III, serves a term expiring December31, 1994.

(6)        In the fourth‑Bsuperior court district, James R. Strickland serves a term expiring December31, 1992.

(7)        In the fifthsuperior court district, no election shall be held in 1992 for the full term ofthe seat now occupied by Bradford Tillery, and the holder of that seat shallserve until a successor is elected in 1994 and qualifies. The succeeding termbegins January 1, 1995. In the fifth superior court district, Napoleon B.Barefoot serves a term expiring December 31, 1994.
