§87‑91.  Notice of violation; remedial action order.

(a)        Whenever theEnvironmental Management Commission has reasonable grounds to believe thatthere has been a violation of this Article or any rule adopted pursuant to thisArticle, the Environmental Management Commission or Department shall givewritten notice to the person or persons alleged to be in violation. The noticeshall identify the provision of this Article or rule adopted pursuant to thisArticle alleged to be violated and the facts alleged to constitute theviolation. The Environmental Management Commission may also issue an orderrequiring specific remedial action. An order requiring remedial action shallspecify the action to be taken, the date by which the action must be completed,the possible consequences of failing to comply with the order, and theprocedure by which the alleged violator may seek review of the order.
