3305.22 Repayment or recovery of amounts paid to alternate payee.
As used in this section, “alternate payee” has the same meaning as in section 3105.80 of the Revised Code. If a person who is an alternate payee is paid any amount under an order issued under section 3105.171 or 3105.65 of the Revised Code to which the person is not entitled by an entity providing an alternative retirement plan, the person shall repay the entity. If the person fails to repay, the entity shall withhold the amount from any payment due the person under the order or may collect the amount in any other manner provided by law.
