GENERALPROVISIONS
188.010Criteria for apportionment of state into congressional and legislativedistricts. TheLegislative Assembly or the Secretary of State, whichever is applicable, shallconsider the following criteria when apportioning the state into congressionaland legislative districts:
(1)Each district, as nearly as practicable, shall:
(a)Be contiguous;
(b)Be of equal population;
(c)Utilize existing geographic or political boundaries;
(d)Not divide communities of common interest; and
(e)Be connected by transportation links.
(2)No district shall be drawn for the purpose of favoring any political party,incumbent legislator or other person.
(3)No district shall be drawn for the purpose of diluting the voting strength ofany language or ethnic minority group.
(4)Two state House of Representative districts shall be wholly included within asingle state senatorial district. [1979 c.667 §1; 1981 c.864 §2]
188.015Secretary of State rules. The Secretary of State shall adopt rules thesecretary considers necessary in carrying out the secretary’s reapportionmentduties under ORS 188.010 to 188.285 and section 6, Article IV of the OregonConstitution. [1989 c.114 §1; 1997 c.249 §55]
CONGRESSIONALDISTRICTS
188.110Election of United States Representative in Congress. OneRepresentative to the Congress of the United States shall be elected in eachcongressional district at the general election every two years. [Formerly250.300]
188.120Filling vacancy in election or office of U.S. Representative or Senator. (1) If avacancy in election or office of Representative in Congress or United StatesSenator occurs before the 61st day before the general election, the Governorshall call a special election to fill that vacancy. If a vacancy in election oroffice of United States Senator occurs after the 62nd day before the generalelection but on or before the general election, and if the term of that officeis not regularly filled at that election, the Governor shall call a specialelection to fill the vacancy as soon as practicable after the general election.
(2)If a special election to fill the vacancy in election or office ofRepresentative in Congress or United States Senator is called before the 80thday after the vacancy occurs, each major political party shall select itsnominee for the office and certify the name of the nominee to the Secretary ofState. The Secretary of State shall place the name of the nominee on theballot.
(3)If a special election to fill the vacancy in election or office ofRepresentative in Congress or United States Senator is called after the 79thday after the vacancy occurs, a special primary election shall be conducted bythe Secretary of State for the purpose of nominating a candidate of each majorpolitical party. A declaration of candidacy or nominating petition may be filednot later than the 10th day following the issuance of the writ of election. [Formerly249.654; 1985 c.586 §1; 1995 c.607 §60]

Note: Afteradjournment of the 2001 regular session of the Legislative Assembly, theMultnomah County Circuit Court ordered adoption of congressional districtboundaries. The court’s order arose out of Perrin v. Kitzhaber, No.0107-07021, which held the congressional district boundaries described in188.135 unconstitutional. The court’s opinion was dated October 19, 2001. Thecourt’s judgment was dated October 30, 2001. The ordered congressional districtboundaries are set forth in 188.140. The text of 188.135 has been deleted. Itis no longer in effect.
188.140Description of congressional district boundaries. The State ofOregon is portioned into five congressional districts composed, respectively,of the following counties or parts thereof:

Note: Chapter 482,Oregon Laws 1961, including the apportionments under 182.210 and 188.220, washeld unconstitutional in In Re Legislative Apportionment, 228 Or. 562,364 P.2d 1004 (1961). A reapportionment drafted by the Secretary of State wasapproved by the Supreme Court in In Re Legislative Apportionment, 228Or. 575, 365 P.2d 1042 (1961), and became law upon filing with the Governor onOctober 27, 1961. Pertinent portions of the reapportionment were printed in the1961 through 1969 Replacement Parts of ORS chapter 171, but thereafter havebeen omitted.
Afteradjournment of the 1971 Regular Session of the Oregon Legislative Assembly, theSecretary of State, pursuant to section 6 (3), Article IV, Oregon Constitution,made a reapportionment, which became law upon filing with the Governor on July30, 1971. The Supreme Court reviewed that reapportionment in Hovet v. Myers,260 Or. 152, 489 P.2d 684 (1971), and returned it to the Secretary of Statewith instructions to correct it in certain particulars and file the correctedreapportionment with the Governor. The corrected reapportionment became lawupon filing with the Governor on October 14, 1971. It is set forth as chapter1, Oregon Laws 1971 Special Session. Pertinent sections of the reapportionmentwere compiled as 188.230 and 188.240.
Chapter261, Oregon Laws 1981, including the Senatorial apportionment under ORS188.230, as amended by section 1 thereof, and the House reapportionment insection 3 thereof, was held unconstitutional in McCall v. Legislative Assembly,291 Or. 663, 644 P.2d 223 (1981). A reapportionment drafted by the Secretary ofState was approved by the Supreme Court in Cargo v. Paulus, 291 Or. 772,635 P.2d 367 (1981), and became law upon filing with the Governor on October29, 1981. Pertinent sections of the reapportionment were compiled as 188.235and 188.245.
Afteradjournment of the 1991 Regular Session of the Legislative Assembly, theSecretary of State, pursuant to section 6 (3), Article IV, Oregon Constitution,made a reapportionment, which was submitted by the Secretary of State to theOregon Supreme Court on August 14, 1991. In Linder v. Keisling, 312Or. 316, 821 P.2d 1089 (1991), the Oregon Supreme Court approved theSecretary of State’s reapportionment as modified in the manner directed by thecourt in Ater v. Keisling, 312 Or. 207, 819 P.2d 296 (1991). Pertinentsections of the reapportionment were compiled as 188.255 and 188.265.
Afteradjournment of the 2001 Regular Session of the Legislative Assembly, theSecretary of State, pursuant to section 6 (3), Article IV, Oregon Constitution,made a reapportionment, which was submitted by the Secretary of State to theOregon Supreme Court on August 15, 2001. In Hartung v. Bradbury, 332 Or.570, 33 P.3d 972 (2001), the Oregon Supreme Court voided the reapportionment.The court directed the Secretary of State to correct the reapportionment in theparticulars discussed in the opinion and to file a corrected reapportionmentwith the court on or before December 1, 2001. The court approved the correctedreapportionment in an order dated December 14, 2001. The correctedreapportionment became operative on December 15, 2001.
Thetext of the reapportionment in effect prior to the operative date of the 2001reapportionment (188.255 and 188.265) has been deleted. The 2001reapportionment as approved by the Oregon Supreme Court is set forth in 188.275and 188.285.
