1210 - Number of slot machines.

     § 1210.  Number of slot machines.        (a)  Initial complement.--Except as provided for Category 3     slot machine licensees under section 1305 (relating to Category     3 slot machine license), the following apply:            (1)  All slot machine licensees shall be permitted to        operate up to 3,000 slot machines at any one licensed        facility.            (2)  Each slot machine licensee shall be required to        operate and make available to play a minimum of 1,500 slot        machines at its licensed facility within one year of the        issuance by the board of a slot machine license to the slot        machine licensee. The board, upon application and for good        cause shown, may grant an extension for an additional period        ending on the later of 36 months from the end of the initial        one-year period or December 31, 2012.        (b)  Additional slot machines.--Except as provided for     Category 3 slot machine licensees under section 1305, six months     following the date of commencement of slot machine operations,     the board may permit a slot machine licensee to install and     operate up to 2,000 additional slot machines at its licensed     facility, beyond those machines permitted under subsection (a),     upon application by the slot machine licensee. The board, in     considering such an application, shall take into account the     appropriateness of the physical space where the additional slot     machines will be located and the convenience of the public     attending the facility. The board may also take into account the     potential benefit to economic development, employment and     tourism, enhanced revenues to the Commonwealth and other     economic indicators it deems applicable in making its decision.
